Brazilian Congresswoman Carla Zambelli Faces Arrest and Asset Seizure
Brazilian Supreme Court Justice Alexandre de Moraes has ordered the arrest of federal congresswoman Carla Zambelli (PL-SP), along with the seizure of her assets, including cryptocurrencies. The decision was made on Wednesday, May 4th.
Zambelli’s legal troubles stem from a criminal case involving alleged forgery and the hacking of electronic devices. If convicted, she could face a 10-year prison sentence, a fine, and R$2 million in damages.
The charges relate to the insertion of false documents into the systems of the National Council of Justice (CNJ).
Justice Moraes’s decision also seeks to remove Zambelli from her parliamentary seat. Walter Delgatti Neto, known as the “Araraquara hacker,” was also sentenced to 8 years and 3 months in prison, along with a fine and compensation order.
Court Orders Seizure of Zambelli’s Assets, Including Cryptocurrencies
The Supreme Court’s decision against Zambelli indicates a broad search for her assets. This includes not only cryptocurrencies but also bank accounts and investment funds. Notably, Zambelli did not declare any cryptocurrency holdings to the Electoral Court during the 2022 elections.
According to Justice Moraes’s decision, the search encompasses:
“Any assets, bank accounts – including those related to her office – and any type of transfers, including PIX, as well as credit/debit cards, and active investments held or belonging to CARLA ZAMBELLI SALGADO DE OLIVEIRA, including custody positions of stocks, private bonds, public bonds and derivatives, investments in investment funds, VGBL, PGBL, investments in LCA and LCI, investments in CDB’s, RDB’s, COE, gold and the like, private pension plans, consortium letters, and cryptocurrencies.”
Investigation into PIX Transfers to Zambelli
The Supreme Court stated that the arrest order followed a request from the Prosecutor General’s Office (PGR). Zambelli’s social media accounts are also under surveillance, and her official profiles have been blocked since the arrest order was issued.
On Thursday, May 5th, Justice Alexandre de Moraes opened a new inquiry to determine Zambelli’s whereabouts, as she could not be found to serve the preventive detention order.
Recently, Zambelli had solicited PIX transfers from her followers, which drew Moraes’s attention. The new inquiry will investigate all transactions to Zambelli’s accounts, identifying those who sent funds in the last 30 days.
Zambelli will receive notifications virtually while she awaits a ruling on her appeal in the Brazilian Supreme Court.
