São Paulo Prosecutor’s Office to Accredit Cryptocurrency Exchanges for Seized Bitcoin Management
The São Paulo Prosecutor’s Office (MP-SP) has initiated a process to accredit Brazilian cryptocurrency exchanges. This move aims to enlist their assistance in managing bitcoins seized during operations, effective this Wednesday (June 4, 2025).
The resolution, numbered 2.078/2025-PGJ and signed by Paulo Sérgio de Oliveira e Costa, the Attorney General of Justice of SP, instructs exchanges to pay attention to future public calls. Selected companies will then be able to support Brazilian authorities in handling seized crypto assets.
However, any company participating in the process must adhere to the regulations outlined in Law No. 14.478/2022, meaning they must be regulated by the Central Bank of Brazil. As the regulator has not yet finalized the regulatory guidelines, as of early June 2025, no company in Brazil is currently eligible to assist the MPSP.
Accreditation of Cryptocurrency Exchanges Aligns with National CNMP Standards
This measure is a response to Resolution No. 288/2024, signed in March of last year by Paulo Gonet, Attorney General of the Republic and President of the CNMP. This resolution “Disciplines the actions of members of the Public Prosecutor’s Office in cases involving the seizure, custody, and liquidation of virtual assets and provides other measures,” according to the National Council of the Public Prosecutor’s Office (CNMP).
Resolution No. 2.078/2025-PGJ, which takes effect this Wednesday, stipulates that the Sub-Attorney General for Strategy and Innovation is responsible for accrediting cryptocurrency exchanges. The regulation refers to these companies as “virtual asset service providers,” or PSAVs.
Furthermore, all accredited companies involved in cryptocurrency liquidation must undergo random rotation, as mandated by the CNMP resolution.
The MP of São Paulo’s resolution also clarifies that public calls for exchange accreditation will occur on three dates, published in the Official Gazette of the State of São Paulo and on the Transparency Portal.
“Finally, the rule makes it clear that accredited brokers must renew their authorizations periodically. “Art. 3º. Accreditation must be renewed every 02 (two) years,” says the new rule of the MP-SP.
State Prosecutor’s Offices Nationwide to Comply with New Standards
The measure implemented in 2024 by the CNMP requires all state prosecutor’s offices to establish rules to comply with the standards.
Resolution No. 288/2024 also states that current regulations in Brazil do not govern the actions of the MPs, such as Law No. 14.478/2022 or Normative Instruction 1.888/2019.
The central bank is expected to release the final rules of the law in the coming months, which will determine which exchanges can operate with cryptocurrencies in Brazil.
